If you do not agree to these Terms, you may not access or use our services. These Terms apply to all visitors, users, and others who access or use our services.
When you place a pre-order for a TalkNWear device, you are reserving a unit for future delivery. By pre-ordering, you agree to the following:

The TalkNWear device, companion application, translation algorithms, and all related content, features, and functionality are owned by TalkNWear, Inc. and are protected by international copyright, trademark, patent, and other intellectual property laws.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of TalkNWear, Inc.
TalkNWear devices come with a 1-year limited warranty from the date of delivery, covering manufacturing defects in materials and workmanship under normal use. This warranty does not cover:
If you are not satisfied with your TalkNWear device, you may return it within 30 days of delivery for a full refund. The device must be in its original condition with all included accessories. Return shipping is free for domestic orders.
While TalkNWear utilizes state-of-the-art AI translation technology, no machine translation is 100% accurate. Translations may contain errors or inaccuracies, particularly with idiomatic expressions, slang, dialects, or low-resource languages. TalkNWear is not liable for any damages, losses, or misunderstandings resulting from translation inaccuracies. The device is intended as a communication aid, not a replacement for professional interpretation in critical situations (medical, legal, or safety-related).
To the maximum extent permitted by law, TalkNWear, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of our services.
In no event shall our total liability to you exceed the amount you paid for the product or service giving rise to the claim.
All TalkNWear devices include lifetime access to online translation services at no additional cost. Offline language packs are available based on your device tier:
Additional offline language packs may be available for purchase in the future. We will notify existing customers of any changes to our pricing model.
We may terminate or suspend access to our services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use our services will immediately cease.
All provisions that should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.
These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Any disputes arising under these Terms shall be resolved in the state or federal courts located in San Francisco County, California.
We reserve the right to modify or replace these Terms at any time. Material changes will be communicated via email at least 30 days before they take effect. Your continued use of our services after changes become effective constitutes acceptance of the revised Terms.
